Supreme Court Denies Americans for Prosperity’s Application for an Injunction Enjoining Delaware’s Disclosure Law

On October 1, 2026, the U.S Supreme Court denied Americans for Prosperity (AFP)’s application for an emergency injunction to enjoin Delaware’s electioneering communications disclosure law in AFP v. Albence. Because both the district court and Third Circuit Court of Appeals also declined to enjoin the law in the proceedings below, the Supreme Court’s order means Delaware’s disclosure law remains standing in this election cycle.
