“The third area, which was telegraphed by the president yesterday, is that we need nine justices on the court because we’re going to have litigation about all of these fraudulent mailed-in ballots. I think what people worry about is a situation where the president is perceived as being ahead on election night, but there will be some effort to shut down the counting of the mailed-in ballots. I don’t know what that effort would be. There might be some kind of lawsuit trying to shut down the count or something more exotic like going to the legislature and asking them to declare a winner,” said Paul Smith, vice president of Campaign Legal Center.
