Walen v. Burgum: Order Granting MHA Nation's Motion for Summary Judgment and Denying Plaintiffs' Motion for Summary Judgment

On November 2, 2023, a three-judge district court granted summary judgment in favor of the Defendant-Intervenors MHA Nation and individual voters who successfully defended a challenge to two North Dakota State House subdistricts that follow the boundaries of Tribal Nations' Reservations. The court found that the non-Native plaintiffs had not met their burden of proving an equal protection violation and denied plaintiffs' motion for summary judgment.
