United States v. State of Oregon and Tobias Read, Order Granting Motion to Dismiss

Date
Court Level
District Court

On February 5, 2026, the Court dismissed all three of the United States’ claims without leave to amend finding that the complaint failed as a matter of law, that plaintiffs’ claims represent an overreach that risks the constitutional separation of powers, and “[p]laintiff’s words and actions outside of the four corners of its complaint in this case, including statements that it intends to create a nationwide database of confidential voter information and use it in unprecedented ways, including immigration enforcement efforts, is chilling.” CLC, along with the Brennan Center and the ACLU, filed an amicus brief in support of the motions to dismiss on behalf of the League of Women Voters of Oregon and the ACLU of Oregon.
