Plaintiffs' Emergency Petition for Extraordinary Relief
On February 26, 2026, Plaintiffs filed an emergency petition seeking extraordinary relief from the Utah Supreme Court. Recently, Plaintiffs filed a supplemental complaint and preliminary injunction challenging the newly enacted H.B. 392 and S.J.R. 5, which create an arbitrary and unilateral power for government litigants to transfer a case from a district court to a three-judge panel. The new laws make this choice not subject to judicial review. Defendants, the Utah Legislature, have moved to transfer our case under this new law. Plaintiffs requested relief is a stay of the transfer until the constitutionality of the new law can be adjudicated.
