Plaintiffs' Complaint — Common Cause v. Mullin
On September 10, 2026, Common Cause and Michael Khalili, a constitutional observer, filed a lawsuit challenging the Trump administration's unlawful policy of intimidating and retaliating against ordinary Americans who observe federal immigration agents' activities. Plaintiffs argue that this policy dissuades and chills the exercise of their First Amendment rights through the use and threatened use of force, collection and use of observers' names and home addresses, and pursuit of criminal charges and administrative penalties. This policy also violates the Privacy Act. Plaintiffs seek declaratory and injunctive relief that would protect the well-established rights of constitutional observers to observe federal law enforcement in the public performance of their official duties.
