Opening Brief of Petitioners: Three-Judge Court Challenge
On June 9, 2026, Petitioners filed their opening brief at the Utah Supreme Court challenging the constitutionality of the Legislature's creation of a new three-judge district court. The Legislature's attempt to remake the state's judiciary violates multiple provisions of the Utah Constitution, including the separation of powers and the constitutional definition of "district court" that has existed in Utah since before the state was founded. Furthermore, the Legislature's contingent creation of a new "constitutional court" is also unlawful because it strips district courts of their constitutional jurisdiction.
