National Religious Broadcasters v. Bessent: Brief Amici Curiae for Campaign Legal Center and Public Citizen in Support of Defendants-Appellees

CLC filed an amici curiae brief on behalf of Campaign Legal Center and Public Citizen arguing that the Fifth Circuit should affirm the district court's refusal to enter a consent judgment exempting Plaintiffs from the Johnson Amendment. The brief argues the Amendment is a viewpoint-neutral subsidy condition, not a speech restriction, so Plaintiffs cannot meet the narrow Williams Packing exception to the Anti-Injunction Act. The brief also argues that exempting churches would open a new class of anonymous, tax-deductible "dark money" vehicles for election spending.
