LWV v. DHS Summary Judgment Opinion
In March 2025, the president issued a sweeping executive order directing various actions related to the administration of elections, including directing federal agencies to put systems in place for state and local authorities to verify the citizenship or immigration status of registered voters. Federal agencies haphazardly combined and repurposed the private information of millions of Americans, including citizenship data that they knew to be unreliable. The overhaul of the SAVE system was challenged in a lawsuit filed by the League of Women Voters and the Electronic Privacy Information Center, who alleged that the modifications made to SAVE made the data less accurate, violated statutory procedures, and were contrary to law. On June 22, 2026, the District Court for the District of Columbia agreed and issued an order requiring the dismantling of the SAVE system as modified because of violations of the Social Security Act, the Privacy Act, and the Administrative Procedure Act. Campaign Legal Center filed an amicus brief in support of plaintiffs in this case. Defendants are appealing.
