Giffords v. Federal Election Commission Opinion

On September 4, 2026, the United States Court of Appeals for the D.C. Circuit issued its decision in Giffords v. Federal Election Commission. In 2019, Giffords, a nonprofit organization founded by Congresswoman Gabrielle Giffords to promote gun safety, sued the Federal Election Commission for failing to act on various complaints Giffords filed regarding the National Rifle Association’s allegedly unlawful campaign spending. Giffords won that case, which permitted the organization to sue NRA affiliates for those violations. Several years later, the NRA tried to overturn Giffords’s judgment against the FEC. The NRA lost in the district court and the D.C. Circuit affirmed, finding that the NRA was not a party and its appeal was therefore inappropriate.
