Comment for Election Assistance Commission Opposing America First Legal Foundation Petition for Rulemaking

On October 20, 2025, Campaign Legal Center (CLC) and Democracy Defenders Fund (DDF) submitted a public comment to the U.S. Election Assistance Commission (EAC) opposing a petition for rulemaking submitted by the America First Legal Foundation (AFLF). AFLF’s petition asks the EAC to require voter registration applicants using the National Mail Voter Registration Form to provide documentary proof of citizenship. CLC and DDF explained that AFLF’s petition mirrors President Trump’s unlawful March 25, 2025, executive order, contravenes the commands of Congress and the EAC, and imposes substantial and unnecessary burdens on U.S. citizens registering to vote.
