Brief of Amici Curiae Justice Connection and Michael Feinberg in Support of Plaintiff's Opposition to Defendants' Motion to Dismiss in Comey v. DOJ
Campaign Legal Center (CLC) filed an amicus brief on behalf of Justice Connection and Michael Feinberg in Comey v. Department of Justice, the wrongful termination suit brought by Maurene Comey, a former top prosecutor who was fired, it seems, for no reason other than her father’s public criticism of President Trump. CLC's brief supports Comey's arguments that the district court should retain jurisdiction to decide her political retaliation claims. The brief discusses the long-established norm of nonpartisanship in the civil service and the importance of protecting civil servants' free speech and association in their private lives. The brief also argues that subjecting Comey's case to a biased agency decisionmaker would undermine Congress' design for a nonpartisan civil service and chill other civil servants in the exercise of their First Amendment freedoms.
