Brief of Amici CLC in Support of Plaintiffs-Respondents in Clarke v. Town of Newburgh

On August 22, 2025, Campaign Legal Center (CLC) submitted an amicus brief to the New York Court of Appeals, the state's highest court, to defend the constitutionality of the New York Voting Rights Act (NYVRA). The brief urges the court to reject defendants’ arguments that the NYVRA violates the U.S. and New York constitutions because federal and state court decisions upholding other state voting rights acts confirm that the NYVRA’s vote dilution ban is a race-neutral anti-discrimination law to which strict scrutiny does not apply; the Act aligns with other anti-discrimination laws that prohibit discriminatory state action; and the Town cannot satisfy the extraordinary showing required to invalidate the ban on its face.
