Americans for Prosperity Foundation (AFPF), et al. v. Albence, et al. — Delaware Files its Opposition to AFPF’s Emergency Application for a Writ of Injunction in the U.S. Supreme Court

On September 23, 2026, CLC filed Delaware’s opposition to AFPF’s application to the U.S. Supreme Court for an emergency injunction barring enforcement of Delaware’s electioneering communications disclosure law pending its petition for certiorari. On behalf of Delaware, CLC argued that the lower courts had been correct to deny AFPF’s motion for a preliminary injunction because the state disclosure law had already been upheld by a 2015 Third Circuit decision and the law was narrowly tailored to advance the important governmental interest in providing information to the electorate.
