A month ago, it looked like the U.S. Supreme Court might rule that extreme partisan gerrymandering was unconstitutional. Now, not so much. The court’s decision to send a Wisconsin case back to district court and Justice Anthony Kennedy’s decision to retire have thrown a wrench in the strategy of reformers trying to do away with the practice.

In this installment of the FiveThirtyEight Politics podcast, we talk to two attorneys involved in litigating gerrymandering, Ruth Greenwood and Michael Li, about what comes next in the gerrymandering debate. With the Supreme Court seeming like a difficult path to reform, activists are looking to states for change.
