Chiafalo v. Washington: Presidential Elections Are Messy Enough Already

As logistical and legal uncertainties over the 2020 presidential election mount, the Supreme Court’s decision this past week in Chiafalo v. Washington provided a welcome respite. The Court unanimously held that states may remove or otherwise penalize “faithless electors” presidential electors who vote for someone other than the presidential candidate who won the state’s popular vote.
