Utah Supreme Court Opinion Voiding Amendment D: Full Opinion

The Utah Supreme Court ruled unanimously that when the Legislature proposed Amendment D — which would eliminate Utahns’ right to reform their government by ballot initiative — the Legislature violated the state constitution by failing to publish the amendment text as required, and by presenting the amendment to voters with misleading ballot language. Amendment D was declared void.
