Sixth Circuit Order

On October 23, 2023, the Sixth Circuit Court of Appeals ruled that Tennessee’s ban on the distribution of absentee ballot applications by anyone other than an election official does not violate the First Amendment. As a result of this decision, civic engagement organizations in Tennessee will be unable to provide absentee ballot applications to their members and communities as part of their voter outreach efforts.
