LUCHA v. Fontes — Supreme Court Partial Stay Order

On August 22, 2024, the Supreme Court issued an order partially staying the LUCHA plaintiffs’ and others’ victory in the trial court during the appeals process. Specifically, the Supreme Court paused the district court’s order and allowed to go into effect — for the first time — provisions of the law requiring documentary proof of citizenship for Arizonans who use the state voter registration form, while keeping the district court’s order in place and preventing changes to mail-in and presidential voting. Justices Barrett, Jackson, Kagan, and Sotomayor would have kept the district court’s order in place and would have kept all provisions from going into effect during the appeals process.
