Common Cause Georgia v. FEC (True the Vote) – Order on Cross-Motions for Summary Judgment

On September 29, the district court ruled that the FEC acted contrary to law when it dismissed plaintiffs’ allegations that True the Vote made, and the Georgia Republican Party accepted and failed to disclose, illegal corporate contributions in the form of coordinated expenditures during the 2021 U.S. Senate runoff elections in Georgia. In particular, the court found that the FEC unreasonably discounted the record evidence of the groups’ collaboration and self-described “partnership” and relied on arbitrary and unsupported legal justifications in determining that True the Vote was not acting “for the purpose of influencing” an election. The court ordered the agency to conform to its decision within 30 days.
