CLC v. FEC (Trump Campaign) – D.C. Circuit Opening Brief

On March 29, 2023, plaintiff-appellant Campaign Legal Center filed an opening brief in its appeal of the district court's dismissal of CLC’s case challenging the FEC’s failure to enforce the law with respect to an administrative complaint CLC filed against former 2020 presidential candidate Donald J. Trump’s campaign and joint fundraising committees, which alleged that the Committees unlawfully concealed upwards of three quarters of a billion dollars in 2020 campaign spending by routing payments to campaign vendors and staff through affiliated firms without reporting their ultimate payees as required by federal law. On appeal, CLC challenges the district court’s finding that the FEC’s dismissal of CLC’s administrative complaint was not judicially reviewable because it was based on an exercise of the agency’s prosecutorial discretion.
