CLC Urges FEC Not to Repeal the Straw Donor “Help or Assist” Regulation

On June 23, 2023, Campaign Legal Center (CLC) filed a comment with the Federal Election Commission (FEC) urging the agency not to repeal a federal regulation that prohibits any person from knowingly helping or assisting in making a contribution in the name of another. CLC’s comment points out that despite a district court’s order, in 2018, holding the regulation invalid, the FEC is not required to repeal the regulation and, in fact, could continue enforcing it in other jurisdictions. CLC’s comment also reiterates this regulation’s important role and purpose in enforcing the statutory prohibition of contributions in the name of another, as the regulation helps to hold accountable any person who helps coordinate or orchestrate a straw donor scheme.
