CLC Comments on FEC’s Draft Legislative Recommendations for 2022

Campaign Legal Center (CLC) filed a comment with the Federal Election Commission (FEC) regarding the Commission’s 2022 draft legislative recommendations to Congress. CLC’s comment generally supported the legislative package, but it noted that one recommendation appeared to be overbroad. The FEC’s draft proposal recommended that Congress repeal 52 U.S.C. § 30118(a) because it was held partially unconstitutional in Citizens United v. FEC. CLC’s comment urged the Commission to redraft this recommendation to clarify that only the portion of the statute struck down by the Supreme Court (the prohibition on corporations and labor unions making expenditures) should be repealed, not the statute in its entirety – as the rest of the statute contains important prohibitions such as the ban on corporate contributions.
