CLC Comments on AZ Advisory Opinion Request — Campaign Media Spending Under Prop. 211

Campaign Legal Center submitted written comments to the Arizona Citizens’ Clean Elections Commission in response to a request for an advisory opinion submitted by Opportunity Arizona (AOR 24-01). The request sought additional guidance regarding whether certain kinds of communications would constitute campaign media spending under the Voters’ Right to Know Act, also known as Prop. 211. CLC’s comments address the second question presented in AOR 24-01, concerning the Act’s coverage of ads that reference a clearly identified candidate close to an election. The comments assert that the interpretation advanced by Opportunity Arizona would undermine the Act’s goal of protecting Arizonans’ rights under the First Amendment and the Arizona Constitution to make informed election decisions and request that the Commission interpret the provision more broadly, in line with federal laws concerning electioneering communications.
