CLC and Protect Democracy Urge FEC to Regulate AI-Based Electoral Fraud

On October 16, 2023, Campaign Legal Center (CLC) and Protect Democracy submitted a public comment in REG 2023-02, a rulemaking petition that asks the Federal Election Commission (FEC) to clarify that the federal campaign finance laws prohibiting fraudulent misrepresentation of campaign authority apply to the use of artificial intelligence (AI). The comment describes the emerging threat of AI-based political ads intended to deceive and manipulate voters and urges the FEC to use its existing statutory authority to clarify that the use of AI to engage in such fraudulent conduct is illegal.
