While it’s true that state legislators have the power to change their rules, Trevor Potter, former commissioner and chairman of the United States Federal Election Commission, explains that they cannot change the rules pertaining to a particular election after the election, which makes sense. A state must count its ballots and certify its results according to the rules in place at the time of the election.
